Josh Duggar’s lawyers are now claiming that, despite confessing to it in 2015, the reality TV star may not have molested five young girls as a teenager after prosecutors asked to include the incident in his child pornography case.

Duggar’s lawyers argue that because he was never charged or arrested in the case, there is no reason to believe he committed the crime in order to establish the alleged “sexual interest in young girls.”

Duggar is set to go on trial in a few weeks for two counts of child pornography possession.

He was arrested in April and is staying with family friends in Arkansas until his trial begins in November.

Josh’s father, Jim Bob Duggar, confessed to authorities in 2015 that his son fondled the breasts and genitals of four of his sisters, as well as a young babysitter, while they were asleep in the parents’ home, according to a police report.

Later, Duggar issued a statement, admitting and apologizing for the act.

According to court documents obtained by The Sun, Duggar’s attorneys fought the prosecutors’ move by claiming that there was no proof of the act.

The documents state, “There is no doubt the allegations at issue arise when Duggar was a child and the allegations at issue in this case arise when Duggar was in his 30s.”

“Additionally, there’s no doubt Duggar was never charged with a crime in connection with those allegations.”

Duggar’s defense also claimed that it is unclear whether the “uncharged allegations” under Arkansas law are actually crimes.

“The Report is heavily redacted and, importantly, does not include the names or dates of birth of anyone involved, making it exceedingly difficult for anyone, much less this Court in ruling on the application of Rule 414, to determine whether Duggar actually committed the acts alleged in the Report and whether the conduct, if committed, constituted a crime, particularly in light of the affirmative defenses clearly set forth in the statute,” the documents said.

The state asked to use the information in court earlier this month, and it was granted.
